This page is for listing and discussing images that are marked as available under a free license or public domain, but have disputed source or licensing information. Images are listed here for 14 days before they are processed. Images that are tagged with a non-free template should not be listed here.

[edit] Instructions

Before listing, remember that files which are already marked unfree and used under fair use should not be listed here.

To list an image on this page:

I
Edit the file page.

Add {{pui|log=2009 July 5}} to the file page. If the file is in use, also add {{puic|File_name.ext|log=2009 July 5}} to the caption(s).

II
Create its PUI subsection.

Follow this edit link and list the file using {{subst:pui2|image=File_name.ext|reason=reason}} ~~~~ (remember to exclude the File: prefix).

III
Give due notice.

Inform the uploader by adding a message to their talk page using {{subst:idw-pui|Image_name.ext}}

Remember to replace "Image_name.ext" with the name of the file

Unlike Wikipedia:Images and media for deletion the primary purpose of this page is to ascertain the source and/or copyright status of an image. Therefore it is not specifically a vote to keep or delete but a forum for the exploration of the copyright status/source of an image and contributions should not be added solely in those terms.

Listings should be processed by an administrator after being listed for 14 days. Images that are accepted following this fourteen-day period should have {{subst:puir}} added to the image talk page and a copy of the issue and/or discussion that took place here put on the image talk page as well. If no objection to the image's deletion is raised, or no proof that the image is indeed free is provided, the image may be deleted without further notice after the 14-day period.

Note: Files can be unlisted immediately if they are indisputably in the public domain or verifiably licensed under an indisputably free license (GFDL, CC-BY-SA, etc.—see Wikipedia:Image copyright tags for more on these). An archiving system was implemented July 2007. For older discussions, see the history pages. For all discussions from July 3, 2007 forward, see the Archive.

[edit] Holding cell

These images have been listed for at least 14 days. Images which have been determined to be acceptable may be removed from this page.

[edit] File:RobertWood.jpg

As a photograph of two-dimensional artwork, we would need to know when it was created to determine whether it is PD for age, or copyrighted by the original artist. Uploader's claim of owning the rights is likely based upon the fact that s/he took this picture, a common mistake. (ESkog)(Talk) 02:53, 22 June 2009 (UTC)

This is a photograph of a painting made by Wood's daughter. I don't understand why if I take a picture of another painting that it isn't in the public domain. Such an argument to the contrary would seem quite silly to me. As to the age of the painting; I don't know. I didn't see it labeled on the painting.Chhe (talk) 02:59, 22 June 2009 (UTC)
Do you think this could be considered a derivative work due to the picture of the frame shown?Chhe (talk) 03:35, 22 June 2009 (UTC)

[edit] File:AmesPainting.jpg

Incorrect licence - Self-taken photo of a probably copyrighted work makes this a derivative work. I could not think of a reasonable rationale to change the licencing Peripitus (Talk) 03:29, 22 June 2009 (UTC)

As with the above image, the only question is the age of the painting. If the painting itself is in the public domain, the photograph can obviously be so released; if it is not, then the photo cannot be. (ESkog)(Talk) 04:37, 22 June 2009 (UTC)
I've tried to find out who and when painted this without luck. - Peripitus (Talk) 07:09, 22 June 2009 (UTC)
I don't know who painted it or how old it is.Chhe (talk) 14:28, 22 June 2009 (UTC)
Where is the painting hanging - perhaps they have a website that tells us the age and creator of this portrait ? - Peripitus (Talk) 21:58, 22 June 2009 (UTC)

[edit] File:Lancaster_courthouse2.jpg

Copyright in artwork not mentioned.. Sfan00 IMG (talk) 14:36, 22 June 2009 (UTC)

I don't get it. It's my own picture, I say so, I say explicitly "Photograph copyright ©2002 by Daniel P. B. Smith. Licensed under the terms of the Wikipedia Copyright," which was the phraseology favored at the time, and I included the GFDL license.

What more "mention" do you need than "Photograph copyright ©2002 by Daniel P. B. Smith?"

The issue isn't the photograph, it's the artwork you photographed which may have a seperate copyright. Sfan00 IMG (talk) 14:48, 22 June 2009 (UTC)

This image (which seems to have been taken from an incredibly privileged viewpoint) looks like a screen capture from a video. Although the image is released as PD by the uploader, a website source is given; the image couldn't be found there. As far as I am aware, the Met Office does not release its content under a free license. J Milburn (talk) 09:47, 23 June 2009 (UTC)

  • Note the image does not originate from the Met Office, although weather data used in the creation of the image did originate from the Met Office. If I said "The Met Office predicted rain today" would I be breaking licensing rules, because that phrase was based upon Met Office data -- I honestly don't know what the rules are. [edit] Uploads by Wneedham02

Given the fact, that this user uplaods several unfree files in the past, see User talk:Wneedham02 my good faith ends here. Some evidence:

  • The Users very first upload was a copyright violation from www.xtinaweb.org. This was delted, he then started to upload images he created himself... why should he upload copyright violations if he have own images? That does not make sense.
  • This PUI request nominates only the rest of a large number of uploads already deleted because of copyright infringement, wrong authorship claims or blatant copyright violation.
  • We have a variety of quality here
  • most images are without EXIF data, the images with EXIF are inconsistent: at least 4 cameras where used, but all photos are self-created.

A list:

Contradictory licencing information: the infobox makes reference to fair use (albeit without a proper rationale), but the copyright tag is {{PD-self}}, which is patently incorrect. Moreover, a fair use claim would not work under WP:NFCC, because presumably it is possible to take freely licenced photos of this artifact.

Note: All image uploads of this user, Nicholasweed (talk · contribs · deleted contribs · logs · abuse filter log · block user · block log), seem to have this problem. This notice applies to all of them; this image is listed only as an example.  Sandstein  16:28, 27 June 2009 (UTC)

Not all images uploaded my myself have this problem. Many are created by myself and I am the copyright holder. A few others were created by another person that has given me full permission to use the images as I see fit for whatever purpose. I am however working to fix the copyright tags on the images that have problems. I just didn’t know what copyright tag needed to be used because nobody has been telling me how to do things. All my efforts have been through trial and error. I only hope I have found the proper tag for the image in question because it is historically important and relevant to the article that it is included in. I would maybe like to have help fixing the problems if someone can help me. If the images get deleted it would very much so hurt the content and understsnding of the articles that they are in.

Image includes Japanese posters used in the Harry Potter and the Goblet of Fire (film) article. The uploader (Stevec240) says the image is his copyright. However, the photographed posters are probably Warner Bros' Non-free posters and the rationale for fair use in the article not obvious, because the article text doesn't mention Japan or Tokyo. File would seem to be a scan from a book according to the file's title. If so, it appears to be a recent book which surely wouldn't be public domain. If the uploader is the author of the book and the person in the image, he needs to provide permission to OTRS. Image is also orphaned. Uploader also originally uploaded the same image 12 minutes later at File:SKPhoto.jpg. - ALLSTRecho wuz here 18:55, 30 June 2009 (UTC)

Comment: appears to be a photograph of Sebastian Kappen. To expand on the "personal collection" comment, see the comment on the most recent file that was uploaded: "I am Dr. Sebastian Kappen's nephew and this photo of his is from my personal collection of photos. Prof. Sebastian Vattamattam". It should also be pointed out, for what it's worth, that this photo represents one of several GFDL-significant contributions by the uploader User:Ase, a username the nominator is presently attempting to usurp. –xenotalk 18:58, 30 June 2009 (UTC)
Nice and interesting find. Wouldn't the image still not be in the public domain if it was the cover of a book? Wouldn't his nephew need to provide OTRS? No problems with withdrawing this if these questions can be satisfied. Not sure what the usurp has to do with it. Not a conspiracy here, I just noticed the issue I've raised while looking at the account's edits and contributions. - ALLSTRecho wuz here 19:05, 30 June 2009 (UTC)

He was warned by me that any further violation would result in him being brought to the attention of an administrator for severely disrupting wikipedia due to his personal actions. Further attempt to confirm the possibility of the file being authorized for reuse was promptly removed by the uploader on his talker page (User talk:AncientObserver) for unknown reasons. Hence, the file being brought to the attention here. Dave1185 (talk) 20:57, 30 June 2009 (UTC)

Undated photo, photographer unknown, in the UK copyright lasts 70 years pma – Quadell (talk) 20:40, 1 July 2009 (UTC)

  • Keep Alice Hargreaves died in 1932 so the photo dates from before then. The photographer is unknown so the image is copyright free under the UK's copyright laws, i.e. the photograph is more than 70 years old. Jack1956 (talk) 20:45, 1 July 2009 (UTC)
  • Keep per above, as the photographer is unknown. IronGargoyle (talk) 15:28, 2 July 2009 (UTC)
  • Comment: "pma" means "after the death of the author". If the photographer died in 1939 or before, then the image is PD. If the photographer died afterwards, it's still under copyright. Without knowing who the photographer is, we can't know if it's copyrighted or not. – Quadell (talk) 15:35, 2 July 2009 (UTC)
Read the tag please. If the photographer is unknown, the copyright expires 70 years after creation. I am aware of the problems associated with trying to prove that a photographer is unknown. However, given that the image comes from Jack1956's personal collection (and I see no reason to doubt this claim), I would assume that he is better aware of the provenance of the image and that there can be no way to plausibly determine its creator. IronGargoyle (talk) 17:03, 2 July 2009 (UTC)
There are a couple problems with that. First off, Jack1956 says that the image comes from his "personal collection", though it's not clear what that means. As mentioned at File talk:Alicehargreaves.jpg, the image is clearly half-toned, which would indicate publishing in a book or magazine... but there's no credit given. Secondly, "unknown" is problematic, as you point out. The Copyright, Designs and Patents Act 1988 says "the identity of an author shall be regarded as unknown if it is not possible for a person to ascertain his identity by reasonable inquiry". If this is a photo in a drawer where no one remember who took it, then that's unknown. But if it was published in a book (as appears likely), and the photographer was credited there, then just because you and I don't happen to know who the author is doesn't make the author "unknown". Thirdly, even if it turns out that the author is "unknown", we still don't know when this photograph was first published. Photographs with "unknown" creators don't go into the public domain in the UK until 2039, if the photos were never published. If they were published, they don't go into the public domain until 70 years after the date of publication. Was this image published before 1939? Neither of us knows, and so neither of us knows if it's PD or not. (See this and this for further info.) – Quadell (talk) 18:05, 2 July 2009 (UTC)
    • Hi all, in trying to shed a little light on this, the original image is a not very good quality photograph that has come down through my family to me. The image in the article is a scan that I made of that photograph. My understanding is that the photograph was taken in 1932 at one of the various events staged to celebrate the 100th anniversary of the birth of Charles Dodgson. I do not know who took the photograph...it may have been a family member and it may not. Jack1956 (talk) 14:32, 3 July 2009 (UTC)

This file, along with File:The Mall Ngamwongwan.jpg and File:City Air Terminal.jpg, was submitted to PUF on 6 March, but was kept due to non-overwhelming evidence of copyright violation, as User:Maxl thought that I seemed to be relying on "a lot of superstition". I was away from editing at that time, however, and had not been able to clarify my position, which is that since all but these three of User:Rootje's uploads have been deleted, mostly due to copyright violations, I believe it wise rather than "superstitious" to cease assuming good faith in such cases. Few users would use a different camera for every shot they upload, and the fact that Rootje has never responded to a talk page inquiry isn't helping his case. Since then, File:The Mall Ngamwongwan.jpg has been confirmed to be a copyright violation and deleted, and I believe the same to be the nature of the other two remaining files. Although this has still yet to be proved beyond all doubt, I believe that given the user's contributions and the inconsistent nature of these uploads, erring on the side of caution would be preferable. [edit] File:Clc-1 clear.jpg

The file itself is probably justified under fair use, but the picture cannot possibly be GFDL as it probably belongs to the Chinese government. Prefer fixing up the source/copyright/attribution but I have no idea how to do this for PRC images. RabidDeity (talk) 07:20, 2 July 2009 (UTC)

[edit] File:Yоung Shop couple.jpg

Image's source text isn't English, but the only indicated date is 1977, which doesn't support the PD-old tag. (ESkog)(Talk) 07:37, 2 July 2009 (UTC)

Uploader claims "own work" with multiple author names, and has changed images uploaded as from another website to "own work" when challenged. This is a low resolution image that looks like a press shot; I doubt the uploader owns the rights to it. J Milburn (talk) 21:57, 2 July 2009 (UTC)

[edit] File:Caynabo 2.png

Image is on flickr (here) noting "all rights reserved" and with an upload date pre-dating this one images by four months. Also present on this blog with a date a few days prior to the flickr one. Either the flickr user and the uploader are the same person, or this image is not verifyably free Peripitus (Talk) 02:24, 3 July 2009 (UTC)

[edit] File:Caynaba.JPG

Image is a duplicate of an all-rights-reserved one on flickr. The flickr image pre-dates this one by four months so unless the flickr user and the uploader of this image are the same person, it is not a free image Peripitus (Talk) 02:26, 3 July 2009 (UTC)

[edit] File:Cham_refugees_in_1944.png

1944 pic of Albanian refugees. It says "According to Albanian law, images of state authorities, made during communism are public domain", but this isn't an official state work. {{PD-Albania}} says anonymous works are copyrighted 70 years, but that won't be until 2015, I think. – Quadell (talk) 16:12, 3 July 2009 (UTC)

It seems to me that if it was taken by a member of the army, it would be an image created by a state authority. IronGargoyle (talk) 02:15, 4 July 2009 (UTC)

A flickr download but it is likely a promotional photo, flickr uploader has no meta data on page. Very unlikely to be a genuinely free image. Polly (Parrot) 22:12, 3 July 2009 (UTC)

[edit] File:Gregory ong.gif

This image, though I cannot find its source on the internet, appears to be an official headshot scaled to webresolution and not the property of the uploader to release into the public domain. The edges as well show that the image has been scaled up before uploading here. Peripitus (Talk) 23:06, 3 July 2009 (UTC)

[edit] File:Neri Abalos.jpg

The image claims both that the uploader owns the image and that the author is "anonymous". This image appears to be a professionally produced taken from a press website, I can see press images of the same event that seem taken from the same angle but cannot find this particular image. No exif an web resolution are just additional hints. Peripitus (Talk) 23:14, 3 July 2009 (UTC)

[edit] File:Badawa, 1936 (5).jpg

Submitter claims the image was "self-made", yet the photo was taken in 1936. Call me crazy, but I'm a bit skeptical. RabidDeity (talk) 23:30, 3 July 2009 (UTC)

  • Comment - The image has a public domain license and a GNU FDL one as well. I don't think it can be both.--Rockfang (talk) 23:46, 3 July 2009 (UTC)
